Five49

Version 1.6 · effective from 23 October 2026

What exactly you get — and what you don't

This is a translation of our Leistungsbeschreibung. The German version is authoritative; if the two differ, the German version prevails. The same rule applies to our terms and conditions (Section 13(5)).

This page is deliberately plain. It lists, point by point, what each service includes, what it expressly does not, which deadlines apply and what rights you have. If you know in advance what you are getting, you will not have to argue about it afterwards.

First things first: the limits of our service

We put this at the top, not in the small print.

What an automated test can do

Five49 runs 24 automated, rule-based checks. They look for failures in 15 of the 55 WCAG 2.2 Level A and AA success criteria. Automated checks can find failures but cannot show that a criterion is met. All 55 criteria, including these 15, therefore also need manual review with a screen reader, keyboard and magnification. The result is neither a conformance statement nor legal advice and gives no assurance of any legal outcome.

The location is the place in the HTML that your page delivers to visitors. The report does not say which file of your theme or shop software produces it.

We test the HTML that your server delivers to a visitor who is not signed in, without running scripts and without entering anything. We therefore test the cart, checkout and customer account only in the state a new visitor sees, for example an empty cart or a sign-in page, and only where they are publicly reachable and not excluded by your robots.txt. Not tested: the cart and checkout steps with goods in the cart (address, shipping, payment), your payment provider's pages, error messages after an entry, content that only a script creates or reveals, and the signed-in area of the customer account.

What we expressly do not provide

Our reports are not a declaration of conformity and not legal advice. We do not assure any legal outcome — no protection against fines, warning letters, lawsuits or measures by authorities. Only you can make the accessibility statement for your offering; with the Snapshot you receive a draft of it, which you review and complete.

For a legal assessment of your individual case, please consult a lawyer. We do not provide legal services within the meaning of the German Legal Services Act (Rechtsdienstleistungsgesetz).

The point in time the report reflects

The state of your pages at the time of testing. Any later change to your website, theme or an installed third-party app can introduce new barriers. That is what Continuous is for.

Term and cancellation: runs for an indefinite period, with a minimum term of three months. You pay for these three months in advance when you order (EUR 447 excl. VAT), and after that EUR 149 a month excl. VAT. You can cancel at any time by email, without notice. The subscription ends at the end of the period already paid for: within the first three months at the end of the minimum term, after that at the end of the month already paid for; until then we keep testing as usual. Once you have received the first test result, we do not refund the amount paid in advance on a pro-rata basis, even if you cancel within the first three months. Your dated evidence archive then remains stored with us and is available to you free of charge on request, at least until the statutory retention periods have expired; at your request we delete it earlier, unless a retention obligation prevents this. Details below under Changes, cancellation, refunds.

Annual payment: annual payment is not available at present; we only offer the payment terms above: the first three months in advance, then monthly. Once annual payment can be booked, the following applies: you pay EUR 1,490 for twelve months in advance — twelve months for the price of ten. The scope of the service is the same. You can still cancel at any time without notice; the subscription ends at the end of the paid year, and until then we keep testing unchanged. If you do not cancel, the subscription continues and the annual amount falls due in advance at the start of each further year. There is no pro-rata refund of a year already paid.

IncludedNot included
Baseline report: up to 25 pages, within 24 hours of receipt of payment, every finding with its location in the HTML—
Code patches for your theme (Shopify Liquid, WooCommerce or WordPress) covering the findings in the baseline report that originate in your theme's code, as changed files against the theme file you send usApplying them on your system
Content findings as a list per page: where a finding sits in the content rather than the code, such as the description of a product photo or a link text, we name the page, the element and the field in your shop admin where the text belongsFilling in these fields
Markup from apps, plugins and page builders: the setting in the plugin or builder where one exists, otherwise the finding and a text you can use to report it to the providerChanges to the code of third-party apps and plugins; Shopify's checkout
Before/after comparison, both dated: once you tell us the patches are live, we test the same pages again and send the after report no later than the following working day. Without a message from you, we test on day 30 after delivering the patches—
30 days of rework on what we deliver, from delivery of the patches: if a patch cannot be applied to the theme you sent us, does not remove a finding it was delivered for, or itself causes a new finding in our test. Your statutory rights in respect of defects remain in place alongside thisErrors caused by your own later changes
—Continuous (a separate service at its own price)
At most two orders per calendar month, on request only. Beforehand we check your shop system (Shopify or WooCommerce/WordPress) and domain. We start once the fee has been received in full. When accepting the order we state the delivery period for the patches in working days, at most 15, counted from receipt of the scope and the complete theme file, and then confirm the exact date—

What we need from you. For the patches we need your theme as a file, in the version that is live in your shop: on Shopify, the theme file you download under Online Store › Themes; on WooCommerce and WordPress, the folder of your active theme as a ZIP file, and for a child theme the parent theme's folder as well. We do not ask for access: no password, no account in your shop, no invitation to your repository. Please do not send a database, customer data or a wp-config.php file either. With the baseline report we propose the scope; if you do not name a different one, it counts as confirmed once your theme file is here, but not earlier than three working days after our proposal. Please apply the patches to a copy of your theme first. We use your theme file only for your Sprint and do not pass it on.

If nothing arrives. With our scope proposal we state the date by which we need the theme file and your confirmation: 14 calendar days later. On the seventh day we remind you. If you ask before the deadline, we extend it once by 14 calendar days. If something is missing from your file, we tell you what within one working day; the deadline then ends no earlier than seven calendar days after that notice. If nothing has arrived by the end, the order ends and within one working day we automatically refund everything except the price of a Snapshot for the baseline report, which you keep.

How we test — and what we never do

We are a guest on your server and behave like one.

  • We test only publicly accessible pages.
  • We respect your robots.txt without exception.
  • We identify ourselves as Five49-Scanner/1.0, with a way to contact us.
  • We do not sign in and use no login credentials.
  • We do not place test orders.
  • We do not circumvent bot protection. If your infrastructure blocks us, we tell you, rather than looking for a way around it.

What we store: the URL tested, the HTTP status, the findings, the code excerpt of the faulty location and the timestamp. For Sprint we also keep the theme file you send us and the patches we write for it. We use the theme file only for your Sprint.

What we do not store: full-text page content, order or user data of your shop, personal data from your source code. The only exception is the theme file from a Sprint: we do not use any personal data it contains.

If something is not right

The most important section of this page.

You think a finding is wrong

Send us the location. We check it and defend nothing in advance. If you are right, we admit the error, send you a corrected report free of charge and record the correction in our log. If the correction does not succeed, you can reduce the fee or, if the error is not insignificant, withdraw from the contract (terms, Section 9(4)). If you are not right, we show you the specific location in the HTML your page delivers — not the rule, but your element.

You do not want to hear from us

One message is enough, in any form. Your address is permanently blocked within 24 hours. We do not ask why and make no attempt to win you back. Your objection under Art. 21(2) GDPR is absolute; we do not weigh interests again.

You want to know what we have stored

We reply within 72 hours with complete information under Art. 15 GDPR: which data, where exactly it came from — with the specific page on which we found your address — on what legal basis, for how long, and every single action with its date. For this we keep a continuous log, secured against later alteration.

On request we delete the entire record. Your address then stays on our suppression list — this is not an exception to the deletion but its precondition: otherwise we could write to you again by mistake.

You are not satisfied with our answer

You can complain to a data protection supervisory authority at any time (Art. 77 GDPR), in particular in the member state of your habitual residence, your place of work or the place of the alleged infringement. We will not stop you, and on request we provide the authority with our complete records.

Reverse chargeFor businesses in other EU member states with a valid VAT identification number
Rights to the resultsYou receive a non-exclusive right to use your reports and records, unlimited in time and territory — including towards authorities and courts. You do not use them as a seal, quality mark or advertising statement about the accessibility of your website.
PublicationWe never name you without your express consent in text form. We publish only anonymised totals.

How the contract is concluded

Orders we check first. If we need to check an order before confirming it, for example because the billing address is outside the EU, the 24 hours start with that confirmation; we tell you so by email after your payment. From Switzerland, we accept orders only from businesses with an active VAT (MWST) number in the Swiss UID register. If we do not accept an order, we refund the full amount.

Steps. You choose the package's button on our website or open the order link we have sent you. On the payment page of our payment service provider Stripe you enter your details: company name, email address, address, payment details and, where asked, your VAT identification number and the address of the shop to be tested. You accept the terms and conditions and confirm that you are buying for your business. With Stripe's payment button you place your order. The contract is concluded when we confirm the order in text form or begin to perform the service (terms and conditions, Section 3).

Input errors. Until you press the payment button, you see all your details on the payment page and can change any field or close the page without an order being placed. If you notice an error only after paying, reply to our confirmation email and give us the correct detail.

Storage of the contract text. We store your order, the version of the terms and conditions you accepted and our order confirmation. You can read, save and print the terms and conditions on this website before ordering; you receive the order confirmation and the invoice by email. On request we send you the version of the terms and conditions that applied to your order.

Languages. You can order in German, English or Spanish, depending on the page or order link. The German version of the terms and conditions is authoritative; the English and Spanish versions are provided for understanding (Section 13(5)). We have not signed up to any code of conduct.

Everything is set out in full in our terms and conditions. This service description summarises them; if the two conflict, the terms and conditions prevail (Section 1(4)).

Changes, cancellation, refunds

Continuous tests up to 100 pages every week. If a test finds a new barrier, we notify you within 24 hours. At your request we run an additional test, at the latest on the following working day. If tested pages move, we keep testing the new address.

You can cancel Continuous at any time by email, without notice. The subscription ends at the end of the period already paid for: within the first three months, which you paid in advance when you ordered, at the end of this minimum term, after that at the end of the month already paid for; until then we keep testing as usual. There is no pro-rata refund for the current period, including the first three months paid in advance. If the contract ends earlier for one of the reasons in Section 7(4) of the terms and conditions, the minimum term does not apply, and we refund the fee paid in advance for the time after that on a pro-rata basis. Your dated evidence archive then remains stored with us and is available to you free of charge on request, at least until the statutory retention periods have expired; at your request we delete it earlier, unless a retention obligation prevents this.

If we have not yet delivered a paid Snapshot, have not yet delivered the baseline report of a Sprint, or have not yet sent you a first test result under Continuous, we refund the amount in full on request. Once the report has been delivered, the service has been provided; after that we do not refund on request, including no pro-rata refund for a current Continuous period. For Sprint, staged rules apply after that: until we start on the patches, we refund everything on request except the price of a Snapshot (EUR 390 net plus the VAT on it, if charged) for the baseline report, which you keep. Once we have started on the patches, we keep the fee, less whatever we save as a result of your cancellation. If we cannot deliver the patches for a reason on our side, or deliver them more than five working days after the date we gave you and you withdraw for that reason, we refund everything. If you think a finding is incorrect, we correct it free of charge (If something is not right). If your site cannot be tested for technical reasons or invoicing details are missing, we ask you once; if there is no reply within 14 days, we close the order and refund automatically. There is no invoice for a scan that was not carried out.

We work with businesses; there is no consumer right of withdrawal. In all other respects, the terms and conditions apply in the version published at the time of your order; their version number and date are shown at the top.
